LITIGATION PROBLEM Litigation is the final phase of someone seeking to resolve a dispute. It typically involves a judge, attorneys, and the court system. Examples of litigation lawsuits include professional malpractice claims, workers’ compensation injuries, personal injury/car accidents, breach of contract cases, eviction matters, sexual harassment/employment matters, probate and estate litigation, and partnership/shareholder disputes. Defendants often consider settling a matter to limit their potential risks: It is cheaper to settle when considering the potential liability exposure, attorneys’ fees, and costs. Courts and juries often award attorneys’ fees, costs, and punitive damages to the plaintiff, which makes lawsuits even more expensive and risky. Courts are sympathetic to plaintiffs and compensate victims (or perceived victims) for their harms — especially against individuals they feel can bear a loss.
